Terms and Conditions

In these terms and conditions, the following is understood: Entrepreneur: The natural or legal person offering products remotely to consumers (Sacré). Consumer: The natural person not acting in the exercise of a profession or business and entering into a distance contract with the entrepreneur. Distance Contract: A contract where, in the context of a system organized by the entrepreneur for distance sales of products, up to and including the conclusion of the contract, exclusive use is made of one or more techniques for distance communication. Right of Withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

These general terms and conditions apply to every offer from the entrepreneur and to every distance contract concluded between entrepreneur and consumer.

Before the distance contract is concluded, the text of these general terms and conditions is made available to the consumer (via the website).

If an offer has a limited validity period or is subject to conditions (such as the waiting list or pre-order), this will be explicitly stated in the offer.

The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer. If the entrepreneur uses images, these are a truthful representation of the offered products.

Obvious mistakes or errors in the offer do not bind the entrepreneur.

The contract is concluded at the moment the consumer accepts the offer and meets the conditions set.

If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm electronically the receipt of the acceptance of the offer (order confirmation by email).

When purchasing products, the consumer has the option to dissolve the contract without giving reasons for 14 days. This cooling-off period starts the day after receipt of the product by the consumer.

During the cooling-off period, the consumer will handle the product and packaging carefully. They will only unpack the product to the extent necessary to assess whether they wish to keep the product.

If the consumer exercises their right of withdrawal, they must report this within the cooling-off period to the entrepreneur (via email).

The risk and burden of proof for the correct and timely exercise of the right of withdrawal lies with the consumer.

The consumer bears the direct costs of returning the product.

The entrepreneur excludes the right of withdrawal for the following products: Sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.

Sacré Explanation: Our perfumes are delivered in sealed packaging (cellophane or seal). If this seal has been broken, the product can no longer be returned.

During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes resulting from changes in VAT rates.

The prices stated in the product offer are inclusive of VAT.

The entrepreneur guarantees that the products comply with the contract, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the legal provisions existing on the date of the conclusion of the contract.

The place of delivery is the address that the consumer has made known to the entrepreneur.

The entrepreneur will execute accepted orders with due speed but at the latest within 30 days, unless a different delivery period has been agreed.

The risk of damage and/or loss of products rests with the entrepreneur until the moment of delivery to the consumer.

Unless otherwise stipulated, the amounts owed by the consumer must be paid immediately upon conclusion of the contract (via Shopify Payments: iDEAL, Credit Card, etc.).

Complaints about the execution of the contract must be submitted to the entrepreneur (via info@scentsofsacre.com) within a reasonable time after the consumer has discovered the defects, fully and clearly described.

Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt.

Contracts between the entrepreneur and the consumer to which these general terms and conditions relate are exclusively governed by Dutch law.
